The Commission met on Tuesday, January 31, 2017. Present were: Presiding Commissioner Curtis Livengood; South District Commissioner Richard Burke; and Susette Taylor, Clerk of the Commission. North District Commissioner Jim Quimby was representing Atchison County at Great Northwest Day in Jefferson City.

Road and Bridge Supervisor Adam Meyer, was present to request approval to move forward with the state bid process to purchase a new pickup for the department. The commission reviewed the state bid and approved moving forward with placing the order as it was approved with his 2017 budget.
Mr. Jason Garst representing the Atchison County Levee District was present to conduct a review of the meeting held with representatives from Senator McCaskill’s Office, Senator Blunt’s Office; Congressman Grave’s Office and Senator Dan Hegeman. The commission realizes the increased pressure that new regulations related to inspections with the Corps of Engineers has placed on the district and would like to offer support if needed.
Clerk Taylor reported that payment was received from Northwest Electric to lease a section of land adjacent to the old landfill site. The commission finalized the Commercial Lease Agreement with Northwest Electric.
Attorney Brett Hurst was in to present the final Real Estate Purchase Agreement & Escrow Instructions between Jerry Brown, Inc., and Atchison County. Documents were signed by Presiding Commissioner Curtis Livengood as authorized by the Certified Order of the Commission on the 10th day of November, 2016. A check in the amount of $12,150 was presented to Brett Hurst Escrow for land purchase and $217.08 for the closing.
Presiding Commissioner Livengood attended the Northwest Regional Council of Government’s monthly meeting on Thursday evening, January 26th.

Road and Bridge Supervisor, Adam Meyer was in for the opening of bids for a snow plow. Two bids were received as follows: Knapheide Truck Equipment – Western 9.5’ MVP 3 Flared Wing V-Plow $6,319 and Badger Body & Truck Equipment Co. – Wester 9.5’ Steel V Blade Snow Plow $6,599. The Commission gave the bids to Supervisor Meyer to review. After review of the bids, Adam recommended going with the bid from Badger Body & Truck Equipment. South District Commissioner Richard Burke made a motion to accept the bid from Badger Truck in the amount of $6,599. Motion was seconded by Presiding Commissioner Curt Livengood, there being no further discussion, a roll call vote to approve the bid was as follows: Livengood – yes; Burke – yes; Quimby – absent.

Thursday February 9, 2017.
No commission held due to mandatory Commission training in Columbia. All commissioners attended the CCAM training.

Mr. Jody Vansickle was in to inquire about the old highway barn property. The commission reported to him that no decisions have been made in regards to the property at this time.
Sheriff Dennis Martin reported that there will be a CPR Class offered at the Velma Houts on February 22. Any Courthouse employees that would like to attend are welcome.

Sheriff Dennis Martin was in to update the commission on his meeting with HMN Engineering and Architectural Firm on building upgrades. At this time only options are being discussed. The meeting was only to obtain information and ideas.
April 11th has been set as County Government Day.
Notice was received from the Department of Natural Resources acknowledging that all violations have been corrected at the Atchison County Sanitary Landfill and it is now in compliance with regards to the violation documented during the September 29, 2016 inspection.
Presiding Commissioner Curt Livengood attended a meeting with the Atchison County Levee Board about the Corps of Engineers management of the River.

Mr. Bill Metzgar met with the Commission at 9:30 a.m. and presented a petition to reopen Atchison County Missouri Road 310th Street in Dale Township. The petition contained 14 signatures, all registered voters in Dale Township.
The petition read as follows: We, the undersigned Atchison County, Missouri voters in Dale Township, petition the Atchison County Missouri Commission to reopen vacated Atchison County Road 310th Street. Said road commences at the intersection of Missouri State Highway N and proceeds in an easterly direction on the section line between Sections 11 and 14, Range 39 for approximately 3,020 feet.
This request is being made because landowners Suzanne Hall Ramsel and Leon and Virginia Olsen are landlocked and have no public access to their property. In addition, there are no recorded easements for the access to their properties.
Landowners adjacent to the vacated road who would sustain no damage if Road 310th Street were reopened are: Section 11 – James and Angela Bowness and Ralph and Gale Ball; Section 14 – Leon and Virginia Olson and Suzanne Hall Ramsel.
The Commission told Mr. Metzgar the signatures would be verified and the petition posted as required if everything was in order.
Mr. Metzgar thanked the commission for their time.
Commission checked the GIS records with the Assessor’s Office and found that this section has been closed for over 60 years and is no longer even documented as a road which means the property has been returned to the landowners on each side and no longer is a county right-of-way. Therefore the commission is seeking legal counsel to see how to proceed since it would need to be a petition to establish a road and costs would need to be presented in the petition.

Clerk Taylor reported that she had sent all the documents and petition related to Mr. Bill Metgzar’s request to Legal Counsel and following his review the commission was instructed to draft the following letter informing Mr. Metzgar of the legal determination.

Dear Mr. Metzgar,
After receiving your petition at the February 21st meeting of the Atchison County Commission and review by legal counsel, it does not comply with the legal regulation set out in Section 228.020 and therefore the petition cannot be processed.
There will be no public hearing on April 6th as discussed.
The section outlined in the petition has been legally closed and has reverted back to the respective landowners. The county has no authority to establish a road on this section. Any petition would have to contain an estimate to condemn the property and signatures of all landowners with an estimate of damages to them.

The Commission signed the document and authorized Clerk Taylor to forward it to Mr. Metzgar.
At 9 a.m. Collector Diane Livengood appeared before the Commission to request that personal property taxes for the years 2011, 2012 and 2013 be outlawed according to RSMo 140.730. The Commission reviewed the detailed information for each year showing the following totals: 2011 Personal Property – $9,875.89; 2012 Personal Property – $9,263.56 and 2013 Personal Property – $8,415.19. After detailed review of the figures provided, North District Commissioner James Quimby made a motion to outlaw a grand total of $27,554.64 for Personal Property taxes for 2011, 2012 and 2013 as outlined in RSMo 140.730. South District Commissioner Richard Burke seconded the motion. Presiding Commissioner Curt Livengood called for further discussion, there being none, a roll call vote to outlaw the taxes requested was as follows: Quimby – yes; Burke – yes; and Livengood – yes. Collector Livengood thanked the Commission for their time.
At 10 a.m. Emergency Management/E-911 Director Rhonda Wiley and Assistant Director Mark Manchester presented bids for new 9-1-1 Communication System. They presented two bids. The first bid was from Commenco on a two position Airbus Vesta 9-1-1 system in full compliance with the RFP. The system proposed includes redundant servers, touch screens, is Phase2 compliant and meets NENA SMS compliant standards. Price includes a statistical package along with operator training. The equipment offered will be covered for 3 years of on-site warranty/maintenance support – $116,302.30. The second bid was from Zuercher Technologies for TriTech 911, NENA i3-compliant Next Generation 9-1-1 call taking software solution. Zuercher proposed a turn-key, comprehensive solution that includes all the requisite application software, third-party hardware and software, and the integration and support services essential to support the ACEM911’s emergency communication goals – Total price with a three year maintenance plan – $137,444.71.
The commission requested that both bids be reviewed for specifications and they will review and vote at the next meeting of the commission.
Assessor Lori Jones EM/E-9-1-1 Rhonda Wiley then visited with the commission about 911 addressing. Assessor Jones wanted to check on some additional information so no final decision was made about potential changes to the 911 addressing procedures.
The commission signed a letter of support for SB 20 and HB 104 eliminating prevails wage for governmental projects.

E-9-1-1/Emergency Management Director Rhonda Wiley was present and recommended that the commission accept the bid from Commenco for the two position Airbus Vesta 9-1-1 system in full compliance with the RFP. Presiding Commissioner Livengood inquired if when the bids were compared they met all specification. Mrs. Wiley reported they did and were very similar. After further discussion the commission tabled acceptance of the bid until they could review the budget details with Clerk Taylor.
