The Commission met Tuesday, May 15, 2018. Present were: Presiding Commissioner Curtis Livengood, North District Commissioner Jim Quimby, South District Commissioner Richard Burke, and Susette Taylor, Clerk of the Commission.
Presiding Commissioner Livengood called the meeting to order.
Minutes of the previous meeting were read and approved.
Bills were reviewed, approved and ordered paid.
The commission discussed donation of sick hours and requested that Clerk Taylor contact legal counsel and follow his direction.
Collector Diane Livengood was in to answer questions presented by the Rod Meinders and Tammy Gibson related to drainage taxes. She stated they would need to contact members of the district about their concerns.
Clerk Taylor reported that eight individuals have accepted the request to serve on the SB40 Board. With one remaining position to fill they hope to appoint the new board by the end of June.
They commissioners will attend a landowner meeting hosted by EDF Renewables for the Brickyard Hill Wind Project Wednesday, May 16.

April 2018 additions and abatements to the tax books were approved as follows:
Additions: 2017, $8,790.37; 2016 $1,042.67; 2015, $343.26.
There were no abatements from the tax books in April.
There were no real property additions or abatements from the real books for April 2018.
Prosecuting Attorney Brett Hurst was present to discuss moving forward with vacating a section of road pursuant to Section 228.190 to abandon and vacate a road. Hurst will prepare the needed documents, it will be posted, and the commission will take action at their May 31, 2018 meeting.

The commission did not meet in regular session Tuesday, May 22, 2018, but participated in the drill conducted by Cooper Nuclear Station at the Tarkio Resource Center.

Clerk Taylor requested that the commission look at a couple of the trees on the courthouse lawn. They have a lot of dead spots and may need to be removed and replaced.

At 9:00 a.m. Presiding Commissioner Livengood opened the public hearing to abandon and vacate a road pursuant to Section 228.190 RSMo. Present for the hearing were: Attorney Brett Hurst, Ryan Harms, and Road and Bridge Supervisor Adam Meyer.
Request Pursuant to Section 228.190 to Abandon & Vacate Road
Comes now the undersigned Affiant/Petitioner and for his request after being duly sworn states to this commission:
1. That the following tracts of land are located in Atchison County, Missouri and are owned by Samuel Craig, Bryce H. Craig, Eleanor S. (Craig) Giordano and Caroline H. (Craig) Platt (hereafter “Owners”), as tenants in common (see attached Exhibits 1, being a Quit Claim Deed showing when and how Owners took ownership of the property):
Tract 1: The east one-half of Section 18, Township 65, Range 39, less that part taken for highway purposes (2.60 A.) leaving 317.40 acres.
Tract 2: That part of the southeast quarter of Section 7, Township 65 of Range 39, lying south and east of the New Channel of the Tarkio Creek (78 acres) all in Atchison County, Missouri.
2. That there runs on the north line of Tract 1 and the south line of Tract 2 a road that is purported to be a public roadway that is further described as follows:
A tract of land commencing at the intersection of Sections 7, 8, 17 and 18, Township 65, Range 39 being the point of beginning; thence west 2,526.53 feet along the north boundary line of Section 18, Township 65, Range 39 and the south boundary line of Section 7, Township 65, Range 39 to the western edge of the Middle Tarkio River. Said road is commonly known as 190th Street, and has a width extending from the centerline of said road of 50 feet.
3.  That the aforementioned roadway has not been used by the public for a period of more than five years. Further, there has been no public monies expended upon said road nor public labor or efforts used to maintain said road for more than five years.
4. That the lands said road touches to the north and south are owned by Owners listed in Paragraph 1, and the lands that the road may allow access to on the east are not land locked with access to said lands being had by county road S Avenue on the south and 190th Street on the north and east. Those lands west of the Middle Tarkio River have access by the portion of 190th Street that is not sought to be vacated.
5. That to maintain the roadway at the subject of this request would not be cost effective to this county.
WHEREFORE, Petitioners/Affiants request that this Commission, pursuant to Section 228.190, RSMo., hold a public hearing and at the end of said hearing, declare the aforementioned roadway abandoned and vacated and record a true and authentic copy of the same with the Recorder of Deeds of Atchison County, Missouri.
Further affiants sayeth not.

The commission reviewed the request to vacate. Presiding Commissioner Livengood asked if the Tarkio Special Road District was in agreement to this closing. Attorney Brett Hurst said they had been contacted and had no opposition to the closing. He then inquired that the district confirms that no tax dollars have been spent on this section of road for five years. Attorney Hurst again confirmed that no tax dollars have been spent. The commission reported that they inspected the section of road to be vacated and saw no reason not to vacate.
South District Commissioner Burke made a motion to vacate as requested. North District Commissioner Quimby seconded the motion. Presiding Commissioner Livengood called for further discussion, there being none, a roll call vote to vacate the section legally described was as follows: Burke – yes; Quimby – yes and Livengood – yes.
Order Abandoning and Vacating a Certain Road
NOW on this 31st day of May, 2018, comes before the Atchison County Commission a request by Ryan Arthur Harms pursuant to Section 228.190, RSMo requesting this Commission to vacate and abandon a certain roadway within the south half of the southeast quarter of Section 7, Township 65, Range 39 and the north half of the northeast wuarter of Section 18, Township 65, Range 39, and within the bounds of Atchison County, Missouri, lands owned by Samuel Craig, Bryce H. Craig, Eleanor S. (Craig) Giordano and Caroline H. (Craig) Platt.
1. The request is found to be in proper form.
2. This Commission did give formal notice of a public hearing pursuant to section 610.020, RSMo by placing a notice of the same within the agenda for 9:00 a.m. on the 31st day of May, 2018 and posting the same according to section 610.020 RSMo. on a bulletin board or other prominent place which is easily accessible to the public and clearly designated for that purpose at the principal office of the Atchison County Commission.
3. That after discussion a vote was had and the Atchison County Commission unanimously voted to abandon and vacate a certain roadway within the south half of the southeast quarter of Section 7, Township 65, Range 39 and the north half of the northeast quarter of Section 18, Township 65, Range 39, and within the bounds of Atchison County, Missouri and more particularly described as follows:
A tract of land commencing at the intersection of Sections 7, 8, 17 and 18, Township 65, Range 39 being the point of beginning; thence west 2,526.53 feet along the north boundary line of Section 18, Township 65, Range 39 and the south boundary line of Section 7, Township 65, Range 39 to the western edge of the Middle Tarkio River. Said road is commonly known as 190th Street, and has a width extending from the centerline of said road of 50 feet.
Wherefore it is the order of the Atchison County Commission that the roadway described in paragraph three of this order is hereby closed, abandoned and vacated.
Order to vacate was recorded with the Atchison County Recorder of Deeds: Book #248, Page #401 .
