The Atchison County Commission met Tuesday, February 11, 2020. Present were: Presiding Commissioner Curtis Livengood, South District Commissioner Richard Burke, North District Commissioner Jim Quimby, and Susette Taylor, Clerk of the Commission.

Presiding Commissioner Livengood called the meeting to order.

Minutes of the previous meeting were read and approved. Bills were reviewed and approved.

The commission reviewed Flood Plain Permit #003-2020 for the City of Tarkio for an electrical vault building and associated grading at Gould Peterson Municipal Airport. There being no questions or concerns related to the permit, the commissioners voted to approve Flood Plain Permit #003-2020 as presented.

The commission made a final review of the first amendment to the lease agreement with Tiffany Care Centers. The commissioners voted unanimously to approve the first amendment.

The commission then reviewed and approved a request for an SOP and OPL county liquor license for Torrey Pines, 401 N. U.S. Hwy. 59 in Fairfax.

The 2020 Region H Hazmat agreement was reviewed and approved as presented.

The commissioners and Clerk Taylor met with representatives from Invenergy and Ameren to review their construction timeline and discuss their EEZ agreement with Atchison County. Road and Bridge Supervisor Adam Meyer was also present for the discussion. The following represented Invenergy and Ameren: Tim Schulz, Ameren Project Manager; Jami Stone, Ameren Manager-Renewables; Ethan Piveral, Ameren Operations Supervisor; Mark Williford, Ameren Construction; David Meiners, Ameren Operations Manager; Don Woody, Ameren Senior Field Consultant; Nate Salmond, Fagen, Inc., Project Manager; Steve Summers, Invenergy – Outlaw Site Manager; Dylan Masi, Invenergy Project Manager; and Louis Feldman, Invenergy Project Manager. Don Woody opened the meeting with introductions of those present.

Louis Feldman, Invenergy Project Manager, then gave a construction update on the project. He reported that the January winter storms slowed down the pouring of concrete pads, but it should resume in March. Work will be shifting to the east side of project. Work on transmission lines and collection cable is beginning. Turbine deliveries will begin May 18 and continue through September. These deliveries will begin with the west side of the project. Current plans are to deliver the blades directly to the site.

Discussion then moved to the EEZ agreements with the Outlaw Project and the ability for the agreements to transfer through ownership change. Clerk Taylor reported that through discussions and reviews of all resolutions and documents with attorney Ivan Schrader, ACDC Director Monica Bailey, Collector Diane Livengood, Assessor Lori Jones, and the Commissioners, all were in agreement that the EEZ abatement would remain in effect with the transfer of ownership. Clerk Taylor will work with the Invenergy and Ameren legal counsel on final wording for the economic agreement which will also be reviewed by the county’s legal counsel before approval.
