State vs. Adam Preston Donica – Plea/Hearing on Felony Possession Of Controlled Substance Except 35 Grams Or Less Of Marijuana/Synthetic Cannabinoid. Case called. State appears by P.A. Smith. Defendants appearance waived and appears by Attorney Scroggie. Case continued to July 11, 2023, at 9:00 a.m. for Plea Hearing.

State vs. Jesse L. Henry – Case Review on Felony Stealing – $750 Or More, Burglary – 2nd Degree, Possession Of Burglary Tools, and Property Damage 1st Degree; and Misdemeanor Trespass – 1st Degree. Case called. State appears by P.A. Smith. Defendant fails to appear as he is in Nebraska custody. Attorney Williams appears. Case continued to July 11, 2023, at 9:00 a.m. for Plea/Trial Setting.

Jessica L. Hogue vs. Mark S. Hogue II – Motion to Modify. Case called. Plaintiff appears in person, and by Attorney Swenson. Defendant appears in person. Tried by court. Judgment granted. Attorney Swenson will prepare form of judgment.

State vs. Aaron J. Jenks – Probation Violation Hearing on Felony. The court takes up defendant’s request to review conditions of release pursuant to Rule 33.06. The court hereby grants conditions of release and bond identical to those set in Case No. 23AT-CR00050-01. Defendant need only post bond once to satisfy both cases.

States vs. Aaron James Jenks – **Possible Section 589.405 RSMo. Charge** Arraignment on Felony Sex Offender Physically Present/Loiter Within 500 Feet Park With Playground/Pool/Museum – 1st Offense. Case called. State appears by P.A. Smith. Defendant appears in person with Attorney Williams. Formal Arraignment waived. Case continued to July 11, 2023, at 9:00 a.m. for Plea/Trial Setting. Bond review taken under consideration. The court takes up defendant’s request to review conditions of release pursuant to Rule 33.06. Upon review of file of this matter as well as file in Case 19AT-CR00061-01 the court finds multiple failures to appear and multiple failures to abide by terms and conditions of probation including reporting to probation officer. The court finds and determines conditions of release including bond as currently set by the court to be proper. Modification is therefore denied.

State vs. Benjamin Mark Marion – Case Review on Felony. Case called. State appears by P.A. Smith. Defendant fails to appear. Case continued to July 11, 2023, at 9:00 a.m. for review. Summons to be sent to defendant.

State vs. David R. Oswald – Probation Violation Hearing on Felony. Case called. Defendant’s Motion for Continuance granted. Case continued to July 11, 2023, at 9:00 a.m. for review.

State vs. John David Smith – Arraignment on Felony Possession Of Controlled Substance and Burglary 1st Degree; and Misdemeanor Violation Of Order Of Protection For Adult. Case called. State appears by P.A. Smith. Defendant appears in person with Attorney Williams. Formal Arraignment waived. Bond review modified by agreement that GPS monitoring requirement removed. Case continued to July 11, 2023, at 9:00 a.m. for Plea/Trial Setting.

Kathleen A. Palu Et Al vs. Kevin J. Palu Et Al – Case Review on Partition. Case called. Plaintiff appears by Attorney Smith. Defendant appears by Attorney Tschauder, via webex. See memorandum and order, to be filed.
