The Missouri Highway Patrol asked 4,368 drivers to take a chemical breath test to determine intoxication during the first ten months of this year. The Patrol reports indicate that 482 drivers lost their licenses for refusal to take the test under the implied Consent Law. The law enacted in 1965 provides that a driver who has been arrested and asked to take the test forfeits his license for one year upon refusal to do so. Of the 3,886 persons who took the test 2,937 showed a concentration of .15 percent blood alcohol. The law sets out that concentrations of .15 percent and higher are prima facie evidence that the person was intoxicated at the time he was tested. Concentrations of less than .15 percent but more than .05 percent are considered as competent evidence in considering whether or not the person is intoxicated.
