The Atchison County Commission met October 30, 2018. Present were: Presiding Commissioner Curtis Livengood, North District Commissioner Jim Quimby, South District Commissioner Richard Burke, and Susette Taylor, Clerk of the Commission.
Presiding Commissioner Livengood called the meeting to order.
Minutes of the previous meeting were read and approved.
Bills were reviewed, approved and ordered paid.
Jim Crawford, University of Missouri Extension was present to introduce Annette Deering, the County Engagement Specialist in 4-H Youth Development. She serves Atchison, Holt and Nodaway counties and her office is housed in Holt County. She updated the commission on future plans related to youth development. The commission looks forward to working with Annette in Atchison County. Mr. Crawford reported on the Nutrition Specialist position still open, which will also serve Atchison, Holt and Nodaway counties, with the office being located in Atchison County. The job has been reclassified as needing a Bachelor’s degree in nutrition and the ad will be going out soon. The hope is to fill the position by January 1, 2019.
Atchison County Development Director Monica Bailey met with the commission to review updated information related to the Brickyard Hill Project. The public hearing to offer tax incentives through the Enhanced Enterprise Zone was originally scheduled for November 13. The Commission received a notice from the Missouri Public Service Commission that the deadline for file and intervention in Ameren Missouri’s request to construct a 157 megawatt wind generation facility in Atchison County was November 2, 2018. This was information that had never been shared with the county. The commission unanimously agreed to postpone the hearing until additional information on the project could be obtained. The reason for the concern is due to the way public utilities are assessed. Tax dollars from the project would not remain in Atchison County if it is owned by a public utility. They would be distributed throughout the entire state. All current farms are privately owned and the power is sold to the public utility. The commission contacted Senator Dan Hegeman and Representative Allen Andrews to relay the concerns.
Presiding Commissioner Livengood made a motion to request Attorney Ivan Schraeder file an Application to Intervene and participate in Case No. EA-2019-0021 for Atchison County. The motion was seconded by South District Commissioner Burke. Presiding Commissioner Livengood called for discussion. There being none, a roll call vote to approve the request to intervene was as follows: Livengood – yes, Burke – yes, and Quimby – yes. Clerk Taylor will draft the request and submit it to Attorney Schraeder.
Road and Bridge Supervisor Adam Meyer presented the renewal agreement with the Department of Conservation for applying rock to the miles of road in the Atchison County Conservation areas for the 2018-2019 contract year. The agreement was signed by Presiding Commissioner Livengood.

Rod Northway and Reed Bartels, developers with Tradewind Energy, met with the commissioners to present an updated county right-of-way agreement with map exhibits for the Outlaw Wind Project, LLC, for review. The developers reviewed maps with the commissioners and stated that they have closed all the right-of way gaps that were in the original agreement and will no longer need to run parallel along the county right-of-way for any material distance. The commissioners voted to accept and approve the amendment to the right-of-way easement agreement as presented. The amended agreement was recorded in Book 248, Page 740 in the Atchison County Recorder’s office, and is on file in the County Clerk’s office.
Atchison County, Missouri, Resolution #2018-03 for Road Use Repair and Maintenance for the Outlaw Wind Project, LLC was read and approved.
The next order of business was to review the language of the road use/maintenance agreement between Outlaw Wind Project, LLC and Atchison County. The commission reviewed the agreement and found all the language that the commission requested had been inserted.
Following review and discussion, the commissioners voted to approve the road use/maintenance agreement with Outlaw Wind Project, LLC as presented. Motion was seconded by North District Commissioner. The signed agreement with exhibits is on file in the County Clerk’s office.
The commission then attended the employee benefit fair at the Velma Houts Building.
