The Atchison County Commission met Tuesday, December 11, 2018. Present were: Presiding Commissioner Curtis Livengood, North District Commissioner Jim Quimby, South District Commissioner Richard Burke, and Susette Taylor, Clerk of the Commission.
Presiding Commissioner Livengood called the meeting to order.
Minutes of the previous meeting were read and approved.
The November settlement from the collector was reviewed and approved.
Bills were reviewed, approved and ordered paid.
Crystal Woodring, Executive Director with Northwest Missouri Living Center, met with the commissioners to make them aware of the Missouri Workforce Crisis and concerns about the new minimum wage law if the state budget is not increased to offset the costs, and what that means for the Living Center in Tarkio. The commission thanked her for the presentation.
The commissioners reviewed a request for a change order to the bid for the new heating and cooling system. The commissioners voted to approve a change order in the amount of $3,407.00 to assist in covering the amount of the Performance Bid Bond related to the project.
Details of the meeting with Ameren were discussed.

DECEMBER 13–
The Commission met Thursday, December 13, 2018. Present were: North District Commissioner Jim Quimby, South District Commissioner Richard Burke, and Susette Taylor, Clerk of the Commission. Presiding Commissioner Curtis Livengood was absent.

DECEMBER 18–
The Commission met Tuesday, December 18, 2018. Present were: Presiding Commissioner Curtis Livengood, North District Commissioner Jim Quimby, South District Commissioner Richard Burke, and Susette Taylor, Clerk of the Commission.

The monthly report of the Public Administrator was reviewed and approved.
Bills were reviewed, approved and ordered paid.
Robert Gibson with Tiffany Care Centers was present to discuss new generator options for Pleasant View Nursing Home. The commissioners had originally wanted to go with a gas generator. After looking into the units, gas is almost double the cost so Mr. Gibson is recommending a diesel unit. The commissioners reviewed the bids and requested Road & Bridge Supervisor Adam Meyer to look in the state bid cost of a diesel unit. The decision was tabled to allow time to look into the state bid options. It will be reopened for discussion at Thursday’s meeting.
ACDC Director Monica Bailey was present to review the amended agreement between Atchison County and Atchison County Development Corporation. There were very minimal changes other than getting signatures of the current commission and ACDC board members. The commissioners voted to approve the amended agreement as presented. The document will be on file at the ACDC office and the County Clerk’s office.
Clerk Taylor presented the Order of the Commission to certify the renewal of the ¼ cent sales tax for economic development. Director Bailey confirmed that the board was in agreement to place it on the April 2, 2019, ballot for renewal.
The commissioners voted to place the ¼ cent renewal on the April 2, 2019, municipal election ballot. The commission then signed the certification for the following proposition:

Shall the County of Atchison County continue a county-wide sales tax at the rate of one-fourth of 1% (1/4) cent, for a period of 5 years from the date of which such tax is first imposed, for funding the operation of the county-wide economic development office?
Road & Bridge Supervisor Meyer was in for discussion on a change order to the new truck from KC Peterbilt. On the original bid a tarp was included on the written specification, but when they priced out the details of the bid, they left the cost of the tarp out. The dealer contacted Presiding Commissioner Livengood to discuss options. After discussion, the commission felt since the county signed the agreement and also failed to realize the cost of tarp was not on the price specs that some of the fault was on the county also. The commissioners voted to split the cost of the tarp with the county paying $1,350 and KC Peterbilt being responsible for the rest. The dealer accepted those terms and a separate check will be issued for the change.
Clerk Taylor presented the new agreement with Schraeder Law Firm for legal services for the county. The commissioners voted to sign the agreement as presented. The commission then signed the agreement.
The Commission then discussed documents related to the following opioid litigation: Atchison County, Missouri vs. AmerisourceBergen Drug Corporation, et al. 5:18-cv-6086-gaf. The commission granted the authority to sign documents related to the case to Atchison County Prosecuting Attorney Brett Hurst.
The commission approved an emergency repair to the sewer line at the Sheriff’s office. Problems began with backup at the Sheriff’s office, which was traced to rebar going through the line during the new parking project. To get to the line the entire drive into the courthouse had to be torn up and replaced. This allowed for the entire line to be replaced which was many years old and in need of repair. There being no time to allow for the normal bidding process, the commission approved the emergency repairs.

Rhonda Wiley, Emergency Management/E-9-1-1 Director, presented the following report:
Notification to all pertinent companies has been made associated with text to 911. Testing should begin with those agencies soon.
We started training yesterday for Code Red, which should be up and running within the week.
I have set up a regional meeting for all region H 911 directors/supervisors. I hope to make this a bi-annual event. I’m setting it up for a venue in St. Joseph, Missouri, on January 11. This has never happened and I think it’s needed, especially with all the legislation to help others within our region.

Robert Gibson reported back to the commission with new numbers on the transfer switch on the Cummins generator, but the stock CAT unit still came in at the lowest bid as requested by Tiffany Care Centers. The commission approved moving forward with the stock CAT generator with enclosure for the Pleasant View facility.
The commission reviewed and signed the 2019 intergovernmental agreement for the Tarkio Special Road District and the Phelps City Road District for distribution of tax funding. They will be forwarded to the districts for final signatures.
The commission finalized the agreements for legal services with all three school districts in regards to Ameren’s purchase of the EDF Project. They are on file in the Clerk’s office.
Presiding Commissioner Livengood opened the public budget hearing at 10:00 a.m. to begin preparation of the 2019 budget. No citizens were present for the hearing. Clerk Taylor presented expenditure reports for 2018 with all departments coming in under budget. The commission authorized Clerk Taylor to begin the 2019 budget process. There being no further discussion, the commissioners voted to begin the 2019 budget process and close the public budget hearing.
Senator Dan Hegeman was present to visit with the commission about upcoming legislation.
