New COVID policy for the courts
Due to the decrease in the national and local levels of COVID-19 cases and the effectiveness and availability of approved COVID-19 vaccines, the Missouri Supreme Court has found the need for Missouri courts to conduct proceedings pursuant to operational phases as set forth in such orders and directives has abated.
According to Missouri Supreme Court Order, dated May 28, 2021, effective June 15, 2021, but which may be implemented sooner, “all appellate and circuit courts – including all associate, family, juvenile, treatment, municipal, and probate divisions – are no longer required to conduct court proceedings and courthouse activities pursuant to the previously prescribed operational phases.
It was further ordered that the “Chief and Presiding Judges shall continue to: (1) monitor local health conditions; (2) consult with local health officials or departments regarding what, if any, precautionary measures are necessary in the community in which the courthouse or court facility is located; and (3) monitor the Centers for Disease Control and Prevention (CDC) COVID-19 guidelines and implement any new or amended guidelines as necessary to ensure the safety of those appearing or working in court facilities.”
Effective June 2, 2021, and until further order:
• For all functions of the court, other than jury trials and in-office meetings between juvenile officers and juveniles and/or parents or guardians, social distancing will not be required nor will face masks be required for those who have been fully vaccinated. Those who have not been fully vaccinated are expected to wear face masks. The court will not inquire as to the status of a person’s vaccination history.
• For jury trials, the court will require all participants to submit to having their temperature taken daily and only be admitted if it is less than 100.4 degrees Fahrenheit or 38 degrees Celsius. Three feet social distancing will be required of all, but face masks will be optional. All areas used will be sanitized daily.
• For in-office meetings between juvenile officers and juveniles and/or parents or guardians, face masks will be optional, but three feet social distancing will be required.
