The Atchison County Commission met Tuesday, December 13, 2022. Present were: Presiding Commissioner Curtis Livengood, South District Commissioner Richard Burke, North District Commissioner Jim Quimby, and Susette Taylor, Clerk of the Commission.

Presiding Commissioner Livengood called the meeting to order.

Minutes of the previous meeting were read and approved.

Bills were reviewed and approved for payment.

Month-end department reports were reviewed and approved.

The commission reviewed the 2023 legal services agreement with Attorney Ivan Schraeder. The agreement provides for 10 hours per month legal telephone support for human resources and other legal matters. The 2023 rate continues at $1,200 per year. Following review and discussion, the commissioners voted unanimously to approve the contract for 2023.

The commission then reviewed the 2022 Region H HazMat Agreement. HazMat services were provided to Atchison County in 2022, but the agreement did not get submitted. North District Commissioner Jim Quimby made a motion to approve the agreement. Motion was seconded by South District Commissioner Richard Burke. Presiding Commissioner Curtis Livengood called for further discussion, there being none, a roll call vote to approve the agreement was as follows: Quimby – yes; Burke – yes and Livengood – yes.

Clerk Taylor reviewed the cyber security audit provided by Midwest Data Center for the emergency management office, courthouse and sheriff’s department. The county will use the information from the audit to apply for a grant. If awarded, the county will be able to greatly enhance their cyber security, which is now required for Missouri government agencies for insurance.

The commission then met with Road and Bridge Supervisor Kamron Woodring to finalize the 2023 Road and Bridge budget. They approved using the state bid to purchase a new pickup for the department. Due to shortage, the county will only be allowed to purchase one at state bid pricing. Woodring will proceed with ordering the vehicle immediately due to shortage and backup. The sheriff is currently still waiting for vehicles ordered last year.

Assessor Lori Jones then presented her 2023 budget for the commission’s review.

The Atchison County Commission met Thursday, December 15, 2022. Present were: Presiding Commissioner Curtis Livengood, South District Commissioner Richard Burke, North District Commissioner Jim Quimby, and Susette Taylor, Clerk of the Commission.

Presiding Commissioner Livengood called the meeting to order.

The commission met briefly to approve Resolution 004-2022. Clerk Taylor reported that the following notice was posted on November 1, 2022, complying with the 45-day notice as required prior to a vote.

The County Commission of the County of Atchison has received cost information for a possible change in retirement benefits for its employees under the Missouri Local Government Employees Retirement System. Section 105.675 RSMo. provides that (a) when a political subdivision is making a substantial proposed change in benefits, a prepared statement regarding the cost of such change shall be prepared in accordance with Section 105.665 RSMo.; (b) the statement of cost shall be made available as public information for at least 45 calendar days before taking final action to adopt the change in benefits; and (c) the statement of cost shall be filed in the office of the clerk, secretary or other individual responsible for keeping the official records, and with the joint committee on public employee retirement In accordance with Section 105.675 Revised Statutes of Missouri. In compliance with section 105.675 RSMo, said cost information shall be made available for public inspection for at least 45 calendar days from today prior adoption of the benefit change. Interested parties may view a copy of this cost information at the Atchison County Clerk’s Office and or by contacting Susette Taylor, Atchison County Clerk at 660-744-6214.

The commissioners voted unanimously to adopt Resolution No. 004-2022 electing changes under the Missouri Local Government Employee’s Retirement System to adopt a change in the Benefit Program of covered employees, changing to Benefit Program L-6 in accordance with 70.655 RSMo.

ATCHISON COUNTY ELECTING CHANGES

UNDER THE MISSOURI LOCAL GOVERNMENT EMPLOYEE’S RETIREMENT SYSTEM

RESOLUTION NO. 004-2022

WHEREAS, the County Commission of the County of Atchison has complied with the notice and filing requirements of Section 105.675 RSMo; and

WHEREAS, the County Commission of the County of Atchison understands that, by adopting this benefit change, the County Commission of Atchison County is accepting the legal obligation to fund the elected benefits now and, in the future, and that it will be financially able to do so.

WHEREAS, the fiscal officer of the County of Atchison is authorized to deduct from the wages or salaries of each employee member, the employee contributions, if any, required by Section 70.705, RSMo, and to promptly remit such contributions to LAGERS, along with the employer contributions required by Sections 70.705, 70.730, and 70.735 RSMo.

NOW, THEREFORE, BE IT RESOLVED that the County Commission of the County of Atchison, an employer under the Missouri Local Government Employees Retirement System (LAGERS), hereby elects the following:

1.) To adopt a change in the Benefit Program of covered employees, changing to Benefit Program L-6 in accordance with 70.655 RSMo.

The clerk will certify this election to the Missouri Local Government Employees Retirement System within 10 days hereof. Such election shall be effective on the first day of January 2023.

This enhanced benefit was reviewed by the Salary Commission, which consists of all elected officials, and requested for adoption in early November. Following that meeting the 45-day public notice was posted. During this time there were no inquiries or questions received.

The commissioners voted unanimously to approve Resolution 004-2022 which will allow the County to move from the present L-12 plan to the L-6 plan as outlined in the actuary study provided by GRS, Gabriel, Roeder, Smith & Company.

Following the vote, the commissioners traveled to Daviess County for the quarterly Northwest Commissioners meeting.
