The following case was heard in Atchison County Circuit Court before the Honorable Brett Hurst at the Atchison County Courthouse in Rock Port, Missouri, Wednesday, December 28, 2022:

Samantha D. Driskell vs. Caleb Z. Vandevere – Trial Setting on Dissolution With Children. Case called. Plaintiff appears in person and by Counsel Pontius-Maynes. Defendant, served on April 13, 2022, failed to appear. Judgment by default. It is therefore ordered, adjudged, and decreed: (A) The marriage is hereby dissolved. (B) Neither party made a claim to maintenance, no order of maintenance to be paid. (C) Division of property as set forth in this judgment is found to be not unconscionable. (D) Petitioner shall have sole legal and physical custody of Ember and Braxtin. (E) Any personal property in the possession of each party is set off to that party. (F) Each party shall execute and deliver appropriate instruments to carry out the provisions of this judgment, if so required. (G) Defendant to pay petitioner $867.00/month for support of minor children by way of income withholding payable to Family Support Payment Center, starting August 1, 2022. (H) In the event of noncompliance with this order, the aggrieved party may file a verified motion for contempt. (I) Each party to pay their own attorney’s fees. (J) Costs of this proceeding are taxed against the petitioner.
