The Atchison County Commission met Tuesday, December 20, 2022. Present were: Presiding Commissioner Curtis Livengood, South District Commissioner Richard Burke, North District Commissioner Jim Quimby, and Susette Taylor, Clerk of the Commission.
Presiding Commissioner Livengood called the meeting to order.
Minutes of the previous meeting were read and approved.
Bills were reviewed and approved for payment.
The commission reviewed a request from the Senior Citizens Tax Board to appoint Roger Martin to fill the unexpired term of Betty Allen. The commissioners voted to appoint Roger Martin to fill the term expiring January 2024.
The commission then reviewed a request from the Library Board to reappoint Jayne Martin to fill a new term of four years. The request to reappoint Jayne Martin to fill a new 4-year term as requested was approved.
The commission reviewed the following order now required for the Collector’s Bond.

The Atchison County Commission unanimously approved the following:
Effective immediately the Commission directs the Atchison County Collector’s Office to make a daily deposit any time $100 or more is collected.
A copy of this order shall be delivered to the State of Missouri along with the original bonds for the Collector and Deputy Collector.
The commissioners voted to adopt the order as presented.
Susette M. Taylor, Clerk of the County Commission, in and for said County, certifed a copy of the proceeding. It also appears on record in her office.
The commission reviewed two separate intergovernmental agreements with the Rock Port Senior Center for reimbursement of improvements and upcoming needs utilizing ARPA Funding. The commissioners voted to approve the agreement for reimbursement of expenses. The second intergovernmental agreement was for approval of items needed for improvements. The commissioners voted to approve the agreement for requested needs.
The commission then met with Sheriff Dennis Martin for his 2023 budget review. Discussion was held about placing a sales tax issue on the April ballot for marijuana. Clerk Taylor will look into the details and have a report for the commission on Thursday.

North District Commissioner Jim Quimby was present via speaker phone due to inclement weather.

Presiding Commissioner Livengood opened the public budget hearing at 9:00 a.m. to begin preparation of the 2023 budget. No citizens were present for the hearing. Clerk Taylor presented expenditure reports for 2022 with all departments coming in under budget. The commission authorized Clerk Taylor to begin the 2023 budget process. The commissioners voted to begin the 2023 budget process and close the public budget hearing.

At 9:30 a.m. Presiding Commissioner Curtis Livengood opened the public hearing to declare a section of County Road H Avenue abandoned under Sec 228.190 RSMo generally following procedures set out in Sec. 228.110 RSMo. The county road is described as follows: Road #430, Township 63, Range 41 Section 8, 9 and 16, excluding 210 feet of Road #430 south from the center line of Road #431 or 307th Street, which will remain open.
Presiding Commissioner Livengood called for a roll call vote to establish a quorum. South District Commissioner Burke, present; North District Commissioner Quimby, present via speaker phone due to inclement weather; Presiding Commissioner Livengood, present.
Road and Bridge Supervisor Kamron Woodring and Atchison County Levee District Board Member Ryan Ottmann were also present for the hearing. A letter that had been accepted by the commission from the Atchison County Levee District requesting the section be abandoned was presented. Supervisor Woodring stated that the public notice ran in the local newspaper for two weeks. Notice was posted at the closing site and certified notices were mailed to both landowners on each side of the section. Those notified were the Atchison County Levee District and Mr. Evan Copsey. No claims forms have been filed to dispute the abandonment by the county.
Testimony was given by Supervisor Woodring that this section has no use now that the new levee setback and seep berm have been built following the flood.
Presiding Commissioner Livengood asked if anyone present felt that there was any reason this section should not be abandoned. Seeing none he called for a roll call vote to declare Road #430, Township 63, Range 41 Section 8, 9 and 16, abandoned, excluding 210 feet of Road #430 south from the center line of Road #431 or 307th Street, which will remain open. The vote to abandon was as follows: Jim Quimby, yes; Richard Burke, yes; and Curtis Livengood, yes.

Lease Agreement
The commission then reviewed the lease agreement to lease the Atchison County laydown site to Watt’s Electric for five months at a rate of $500.00 per month with payment to be paid to the county in advance. The site will be used to store poles for a utility project in Atchison County. The commissioners voted to approve the lease.
